Meta Model API Model Designation and Geographic Use Policy

This Meta Model API Model Designation and Geographic Use Policy (“Policy”) describes where you may use the Services and where you may deploy your Integrated Products. This Policy is part of, and subject to the Meta Model API Terms of Service (“Terms”). Capitalized terms not defined here have the meanings given in the Terms.

1. Model Designations.

As used in the Terms and all policies incorporated therein, the following Meta Models are designated as Standard Models or Discounted Models:

Standard Models (use constitutes “Standard Services”):

• Muse Image
• Muse Spark 1.1
• Muse Spark 1.2
• Muse Spark 1.3
• Muse Voice Transcribe
• Segment Anything Model 3.1 (SAM 3.1)

Discounted Models (use constitutes “Discounted Services”):

• Muse Spark 1.2 Contributor
• Muse Spark 1.3 Contributor

Meta may update these designations, and add or remove models, at any time by updating this Policy.

2. Availability.

2.1 General Availability. The Services are not available in all jurisdictions. Meta controls where the Services are available through technical and other means, and may enable or restrict access in any jurisdiction at any time in its sole discretion.

You may access the Services only in jurisdictions where Meta has enabled access. You may not use technical measures to circumvent, bypass, or otherwise evade geographic access controls.

Meta may publish informational resources indicating current availability. Any such resource is provided for convenience only, is not part of this Policy or the Terms, does not guarantee continued access in any jurisdiction, and may not reflect real-time availability.

2.2 Model-Specific Availability. Certain Meta Models are not available in all jurisdictions where the Services are otherwise available. For each Meta Model listed below, you may not access that Meta Model from, and you may not make Integrated Products that use that Meta Model available to or knowingly permit access by End Users located in, the jurisdictions identified below:

Meta may update these restrictions, and add or remove models or jurisdictions, at any time by updating this Policy.

3. Restricted Territories.

You may not access the Services from, and you may not make Integrated Products available to or knowingly permit access by End Users located in, any of the following territories (“Restricted Territories”):

• Afghanistan
• Belarus
• Cambodia
• People's Republic of China (including Hong Kong SAR and Macau SAR)
• Cuba
• Eritrea
• Ethiopia
• Haiti
• Iran
• Iraq
• Libya
• Myanmar
• Nicaragua
• North Korea
• Pakistan
• Russia
• Somalia
• Syria
• The Crimea, Donetsk, and Luhansk regions of Ukraine
• Venezuela
• Western Sahara

4. Trade Compliance.

Independent of the restrictions in Sections 2 and 3, you are responsible for complying with all applicable trade laws and regulations in connection with your use of the Services and your offering of Integrated Products, including:

• U.S. sanctions administered by the Office of Foreign Assets Control (OFAC);
• EU and UK sanctions;
• United Nations Security Council sanctions; and
• U.S. and other applicable export control laws.

You are solely responsible for determining whether the Services may lawfully be accessed or Integrated Products may lawfully be made available in any jurisdiction not listed in Section 2.

5. Restriction of Access; Notice.

If Meta restricts availability in a jurisdiction where you are actively using the Services, Meta will use commercially reasonable efforts to provide prior notice, except where immediate action is required to:

• comply with applicable law or regulation;
• respond to a government or regulatory request; or
• address a security concern.

This notice obligation applies solely to jurisdiction-wide availability changes under this Policy and does not limit Meta's rights under Sections 11 and 15 of the Terms.

6. Updates.

Meta may update this Policy at any time, including to reflect changes in applicable law, regulations, sanctions requirements, or the geographic availability of the Services. Material changes to the Restricted Territories or the restrictions in Section 3 will be communicated to you in accordance with the Terms.
